Use YesIQ responsibly

1. Who provides YesIQ

YesIQ is operated by ITYES IT FACTORY S.R.L., a company established in Romania ("ITYES", "YesIQ", "we", "us" or "our"). Trade Registry number: J15/1504/22.11.2018. Registered office: Crevedia, Strada Dârzei 3 A3, Dâmbovița, Romania, 137180. VAT/tax identification number: RO40200849.

2. Acceptance and authority

These Terms govern access to and use of the YesIQ website, API, MCP tools, previews, reports and related services (the "Service"). The Service is offered exclusively for business or professional purposes and not for personal, family or household use. By using the Service, you confirm that you act in a trade, business, craft or professional capacity.

If you act for an organization, you confirm that you have authority to accept these Terms and make the purchase on its behalf. If you do not meet these requirements or do not agree, do not use the Service.

3. What the Service does

YesIQ performs a bounded review of publicly accessible website pages and produces business-oriented observations about areas such as conversion, customer experience and potential automation. A free preview may be followed by a paid, expanded report and PDF.

Every recommendation is an opportunity hypothesis based on limited public evidence—not a finding of fact, promise of benefit or instruction to implement a particular change.

4. Important limitations

The Service uses automated collection and artificial-intelligence systems. Results may be incomplete, inaccurate, outdated, duplicated or unsuitable for your circumstances. A limited crawl may not observe JavaScript-only content, private systems, analytics configuration, offline processes, contractual restrictions, internal controls or recent changes.

YesIQ is not a legal, financial, tax, accounting, investment, cybersecurity, penetration-testing, accessibility, regulatory, medical or other professional-advice service. A report is not an audit, certification, compliance assessment, vulnerability scan, valuation or guarantee of revenue, savings, ranking, conversion or any other outcome.

5. Your decision and implementation responsibility

You remain solely responsible for deciding whether and how to use a recommendation. Before investing, publishing or changing a system or business process, you must:

6. Websites you submit

You may submit only a public website that you are lawfully entitled to analyze for a legitimate purpose. You confirm that your use will not violate law, contract, confidentiality, intellectual-property rights, website terms or the rights of another person. Do not submit credentials, private URLs, personal dashboards, intranet addresses, secrets or content that requires access controls to be bypassed.

Website operators may change or block access at any time. YesIQ may respect applicable access restrictions and may decline or stop an analysis.

The applicable price, currency, taxes and payment obligation are shown before checkout. Stripe processes payments and may collect billing information. YesIQ does not receive full card details.

Immediately before checkout, you must expressly confirm your business or professional use, acceptance of these Terms and immediate delivery of the digital report. We record the accepted Terms version, the acceptance time, the business-use confirmation and the associated purchase and analysis identifiers.

After Stripe confirms payment, the full report is generated from the public website evidence already collected and is delivered without undue delay through the Service. Because this is a business-only service with immediate digital delivery, purchases are generally final except where a refund is required by law or we fail to provide the purchased report.

Nothing in these Terms excludes any guarantee, remedy, refund right or other protection that cannot lawfully be excluded. For billing, access or refund assistance, contact [email protected] and include the purchase email and analysis identifier.

9. Report access and account-free delivery

Some reports use an unguessable access link instead of an account. Anyone who receives that link may be able to open the report. The paid report and PDF download remain available for seven days after payment confirmation. You are responsible for downloading the PDF during that period, storing it securely and not forwarding the link publicly. Contact support promptly if you believe a link has been disclosed.

10. Licence and intellectual property

Subject to payment and these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the delivered report for your internal business or professional purposes. You may share it internally and with professional advisers who are bound to protect it.

Website owners retain their rights in source content and marks. ITYES and its licensors retain all rights in the Service, software, designs, report structure, original analysis, models, prompts, methods, trade secrets and associated intellectual property. No right to source code, internal instructions, model configuration or implementation details is granted.

11. Public content and confidentiality

A submitted public URL and the public content available from it are not treated as your confidential information. Do not submit secrets or non-public material. We will handle personal data as described in our Privacy Notice.

12. Third-party services and links

The Service may be accessed through or interact with third-party services, including Stripe, ChatGPT, Codex, AI agents, applications, plugins, MCP clients, authentication providers and websites being analyzed. Their availability, content, decisions and practices are controlled by them and may be governed by separate terms. We do not guarantee that YesIQ will remain available through OpenAI or any other third-party interface.

YesIQ is not sponsored, endorsed or operated by OpenAI unless expressly stated otherwise. An MCP client or AI assistant may request a website analysis or create a Stripe Checkout link only after your explicit instruction and confirmation. It does not submit your card details, confirm payment or charge you; those actions remain separately controlled by you in Stripe Checkout.

13. Availability, changes and suspension

We may maintain, modify, limit or discontinue features, and may suspend abusive, unlawful or security-threatening activity. We do not promise uninterrupted or error-free availability. Where reasonably possible, changes affecting a paid report already purchased will not remove the customer’s mandatory rights.

14. Disclaimers

To the maximum extent permitted by applicable law, the Service and its outputs are provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy where such disclaimers are legally permitted. This clause does not limit rights that cannot lawfully be excluded.

15. Liability

To the maximum extent permitted by law, ITYES is not liable for indirect, incidental, special or consequential loss, loss of profit, revenue, opportunity, goodwill or data, or costs arising from a decision made without the verification required by section 5.

ITYES’s aggregate liability arising from the Service will not exceed the total amount paid by that user for the report giving rise to the claim. This limitation does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, or obligations that cannot lawfully be limited.

16. Responsibility for unlawful use

If you use the Service on behalf of a business, you are responsible for claims and reasonable costs resulting from your unlawful submission of a website, infringement of third-party rights or material breach of sections 6 or 7, except to the extent caused by ITYES.

17. Governing law and disputes

These Terms and the contract for the Service are concluded in English and governed by Romanian law. Romanian courts have jurisdiction for business disputes, subject to any mandatory rule that applies. Nothing here removes rights that applicable law does not permit the parties to exclude. Please contact us first so we can try to resolve a complaint promptly.

18. General terms

If a provision is unenforceable, the remaining provisions continue to apply. A delay in enforcement is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a restructuring or transfer of the Service without reducing mandatory rights. These Terms, the purchase information and the Privacy Notice form the agreement for the Service. The Terms version explicitly accepted at checkout governs that purchase.

19. Changes and contact

We may update these Terms when the Service, law or providers change. The effective date above identifies the current version. Material changes will apply prospectively unless law requires otherwise. Contact: [email protected].
